New York’s adult-use cannabis rollout hit another legal wall in December 2024 when Albany County Supreme Court Judge Sharon A. Graff issued a preliminary injunction blocking the Office of Cannabis Management from processing certain categories of retail license applications. The case was brought by four license applicants and centered on OCM’s handling of two separate application windows opened in late 2023. The November 2023 window required applicants to have a secured, municipally noticed location to qualify. The December 2023 window allowed provisional applications without a secured location, and plaintiffs argued this created an unfair scenario where a later applicant could effectively block a qualified earlier one. Judge Graff agreed, finding that regulators had acted arbitrarily and capriciously and beyond their statutory authority, and concluding that the plaintiffs were likely to succeed on the merits. The ruling froze roughly 340 pending CAURD applications and an unknown portion of the 3,189 provisional applications filed that December.
This was not an isolated event. It was at least the fifth time courts have stepped in to halt or disrupt New York’s cannabis licensing process since legalization passed. The pattern is consistent: operators invest time, money, and effort to comply with the rules as written, only to have those rules shift or be applied inconsistently, triggering legal challenges that freeze everyone in place. The injunction was partially narrowed through follow-up court orders in late December, but the underlying lawsuit continues and licensing uncertainty remains. New York has over 260 adult-use stores open and has crossed $1 billion in cumulative legal sales, real momentum that deserves a regulatory process stable enough to build on.
